The Court of Queen’s Bench has amended its Criminal Law Practice Directive #4 respecting the issuance of subpoenas in criminal matters. Parties seeking a subpoena must now print on the subpoena a notice to the recipient concerning their choice of oath. The amended practice directive also clarifies when a Court Order is required to obtain a subpoena addressed to an out of province witness. The amended subpoena can be found on the Courts’ website. The Court has also cancelled Criminal Law Practice Directive #2 related to Jury trials as the matters addressed in the directive are now addressed in the Criminal Code.
