SUMMARY:Hybrid Seminar - Getting It Done: Resolving Family Proceedings on a Final Basis without Going to Trial (CPD 405)
DESCRIPTION:Qualifies for 4.5 hours\, and 1.0 Ethics \nTCU Place\, 35 – 22nd Street East\, Saskatoon \nJoin us for a full-day seminar on resolving Family Law matters at various stages of proceedings prior to trial. From summary judgment applications to binding pre-trial conferences\, the morning sessions will inform practitioners of their duties when preparing for applications\, negotiations\, and settlement of claims. Presenters will provide guidance for running an effective pre-trial conference with topics such as preparing the pre-trial brief\, applications in advance\, and considerations around self-represented litigants and interpersonal violence. The afternoon will focus on effective documentation of resolutions using Interspousal Agreements and Minutes of Settlement. The sessions will provide drafting considerations involving tax implications and dealing with third parties and will discuss when to consider pursuing a final Judgment. Presenters will explore avenues for further resolution when the pre-trial conference does not result in a settlement\, or there is a desire to vary the terms of the settlement. This will include discussion of the legislation\, case law and process around viva voce hearings. \nAgenda CPD 405 \n___\nEarly bird pricing is in effect until October 24. DESCRIPTION:Qualifies for 1.0 CPD hour\, all of which qualifies for Ethics \nIn this webinar\, Sharmi Jaggi\, discusses her study on the application of Gladue factors in Saskatchewan’s lower courts. The over-representation of Indigenous peoples in Saskatchewan’s criminal justice system is a critical issue of law and public policy. Reducing Indigenous people’s high rates of incarceration must start with understanding the processes used in their sentencing\, and particularly why they receive relatively harsher sanctions than non-Indigenous offenders. \nWhile the Supreme Court of Canada’s decision in R v. Gladue has been praised for recognizing the ways that the criminal justice system has failed Indigenous people and requiring that judges consider the need for culturally appropriate sanctions and sentences\, the courts have been unable to affect meaningful change in incarceration rates. This research study set out to understand why Indigenous sentencing is not living up to its promise by building on a contextual framework for understanding judicial decision-making. In order to do so\, a four-month observational study of 118 sentencing decisions of judges in two provincial courts in Saskatchewan was conducted. \nThe findings of this study demonstrate that the practical constraints of the lower court’s institutional environment\, cognitive constraints\, and legislative complexity stifle the consistent application of s. 718.2(e) of the Criminal Code and the Gladue principles. \nPresenter: Sharmi Jaggi\, Ph.D.
