SUMMARY:Free Webinar - A Critical Examination of the Application of Gladue Factors in Saskatchewan's Lower Courts (CPD 390)
DESCRIPTION:Qualifies for 1.0 CPD hour\, all of which qualifies for Ethics \nIn this webinar\, Sharmi Jaggi\, discusses her study on the application of Gladue factors in Saskatchewan’s lower courts. The over-representation of Indigenous peoples in Saskatchewan’s criminal justice system is a critical issue of law and public policy. Reducing Indigenous people’s high rates of incarceration must start with understanding the processes used in their sentencing\, and particularly why they receive relatively harsher sanctions than non-Indigenous offenders. \nWhile the Supreme Court of Canada’s decision in R v. Gladue has been praised for recognizing the ways that the criminal justice system has failed Indigenous people and requiring that judges consider the need for culturally appropriate sanctions and sentences\, the courts have been unable to affect meaningful change in incarceration rates. This research study set out to understand why Indigenous sentencing is not living up to its promise by building on a contextual framework for understanding judicial decision-making. In order to do so\, a four-month observational study of 118 sentencing decisions of judges in two provincial courts in Saskatchewan was conducted. \nThe findings of this study demonstrate that the practical constraints of the lower court’s institutional environment\, cognitive constraints\, and legislative complexity stifle the consistent application of s. 718.2(e) of the Criminal Code and the Gladue principles. \nPresenter: Sharmi Jaggi\, Ph.D.

The researchers involved in the assessment will present their findings and key insights to advance access to justice within Saskatchewan. \nThe presenters are: \n\n– Brea Lowenberger\, BA\, JD\, LLM\, is Saskatchewan’s Access to Justice Coordinator and Cofounder/Director of CREATE Justice\, an action-oriented access to justice research lab at the University of Saskatchewan (U of S)\, Canada\, that is working on transforming legal and justice services and the removal of systemic barriers to justice; and a sessional lecturer for the award-winning Dean’s Forum on Access to Justice and Dispute Resolution course at the U of S.\n\n\n– Dr. Bryce Stoliker holds a Ph.D. in Criminology and is a Research Officer at the Centre for Forensic Behavioural Science and Justice Studies at the University of Saskatchewan. Joining the Centre in 2020\, Dr. Stoliker has been involved in various research and evaluation projects tasked with assessing criminal justice processes\, as well as examining programs and services for justice-involved individuals. (Hons)\, LL.B. (University of Saskatchewan)\, LL.M. (Harvard) is an Associate Professor and Associate Dean Research and Graduate Studies at the College of Law\, University of Saskatchewan. Her teaching and research areas have focused on business\, trade\, oil and gas and administrative law\, with particular interest in risk assessment and data-informed\, justice sector reform. Heather joined the faculty in 2003 after practicing with the firm of MLT LLP (now MLT Aikins) and clerking to Chief Justice E.D. Bayda of the Saskatchewan Court of Appeal. She is an award- winning teacher\, a former member of the JSGS School of Public policy\, member of the Forensic Centre for Behavioral and Justice Studies and the CREATE Justice research centre at the University of Saskatchewan.\n\n\n– Jessie Buydens is a partner at Scott Phelps Mason in Saskatoon and is the current Treasurer for the CBA Saskatchewan Branch. She received her LLB in 2006 and her LLM in 2008 from the University of Saskatchewan. She has a general practice which encompasses several areas of the law including litigation\, criminal law\, and family law. She also practices in the areas of wills\, estates\, and real estate law. She is the recipient of the Lady Justice Award from the Elizabeth Fry Society in 2019 and the Community Service Award from CBA Saskatchewan in 2021. She has extensive volunteer involvement\, but her passion is Rugby.\n\n\n– Dr. Lisa Jewell is a Research Associate at the Centre for Forensic Behavioural Science and Justice Studies at the University of Saskatchewan. She has a PhD in Applied Social Psychology from the University of Saskatchewan and is a Credentialed Evaluator through the Canadian Evaluation Society. Dr. Jewell has over 17 years of research and evaluation experience and specializes in evaluating programs operating within the criminal justice system\, including those offered by corrections\, police\, justice\, and community-based organizations.\n\n\n– Pamela R. Kovacs\, BComm (McGill University)\, LLB/JD (University of Saskatchewan)\, MA (United Nations University) is Senior Policy Counsel with the Law Society of Saskatchewan with a focus on the future of legal services\, equity\, diversity\, and inclusion\, and Truth and Reconciliation. Pam joined the Law Society in 2020 following a decade of work in international development and prior to this as the Executive Director of Pro Bono Law Saskatchewan and as a law firm associate. Pam has researched\, written\, and presented on issues relating to the rule of law\, access to justice\, transitional justice\, legal representation for children and youth\, pro bono legal services\, and the operation of law clinics.

DESCRIPTION:Qualifies for 3.0 CPD hours\, all of which qualify for Ethics hours. \nArtificial Intelligence is quickly being woven into all aspects of our digital infrastructure and is impacting a wide range of domains including the practice of law. Some of these impacts are beneficial. However\, there are also numerous examples of AI systems that are creating harmful\, unjust and discriminatory outcomes. How can we ensure the AI tools\, especially ones used in high-stakes domains like legal work\, are trustworthy and informed by societal values? This workshop provides an introduction to the topic of AI ethics. We’ll illustrate some of the core ethical concerns raised by modern AI systems\, including generative AI/ChatGPT\, using Ethically Aligned AI’s Data\, Models and People Framework. Attendees will gain a better understanding of how modern AI actually works including the role of data in machine learning models. SUMMARY:Free Virtual Seminar -  Mental Health and the Legal Profession: Improving Lawyer Well-being (CPD 367)
DESCRIPTION:Qualifies for 3.5 CPD hours\, all of which qualify for Ethics. \nWhat can legal organizations\, firms\, law societies and legal educators do to improve lawyer well-being? In this virtual seminar\, Dr. Nathalie Cadieux and moderator Erin Kleisinger\, K.C.\, discuss the recommendations and findings of the National Study on the Psychological Health Determinants of Legal Professionals in Canada. Erin was the Chair of the National Well-Being Study Steering Committee with the Federation of Law Societies of Canada\, which partnered with the Université de Sherbrooke and the Canadian Bar Association to conduct the study. Phase I of the study\, conducted by Dr. Cadieux and published in October 2022\, surveyed legal professionals to determine the scope of the problem\, distinguish regional differences and explore the causes of substance abuse and poor health outcomes in the profession.
