Thunderchild First Nation - 2 Vacancies on the Appeal Tribunal 

Background

 

  • Thunderchild First Nation (“Thunderchild”) is a signatory to Treaty 6.
  • Thunderchild has developed a Constitution, Election Act and Appeals Tribunal Act, all of which govern disputes related to, among other things, elections.
  • Thunderchild’s general election for one (1) Chief and seven (7) Headmen was on October 15, 2018.
  • An Appeals Tribunal was in place prior to October 15, 2018.
  • Since Thunderchild’s general election there have been two vacancies on the Appeal Tribunal.
  • Thunderchild is seeking two (2) persons to fill the vacancies on the Appeal Tribunal.

 Qualifications

  1. Pursuant to section 7.02 of the Constitution an applicant must:
  • be an individual who is in good standing with Thunderchild;
  • be of good character and reputation;
  • educated and experienced in law; and
  • independent and impartial.

Preference will be given to qualified First Nations individuals with Cree ancestry.  Section 7.02 of the Constitution is set forth below.

“An Appeal Tribunal member must be an individual who is in good standing with Thunderchild First Nation, of good character and reputation, educated and experienced in law, independent and impartial, have no criminal record, was at no time disbarred from practicing law, and with preference of appointment given to First Nations persons of Cree ancestry with equal qualification.”

 

  1. The Election Act elaborates on the qualifications set forth in the Constitution. Specifically, section 3.02 of the Election Act sets out:

“Without restricting the application of Article 7.02 of the Constitution, the Government shall adhere to the following as minimum qualifications when selecting Appeal Tribunal members:

(a) Of good character and reputation” which shall mean those characteristics that would be regarded by a reasonable man as falling within such description and good character and reputation shall be assumed if no contrary facts are shown;

(b) Educated and experienced in law” which shall mean a lawyer who is a member in good standing of one of the Law Societies of Canada who has practiced law for at least ten (10) years and reduced to at least five (5) years if the lawyer fluently understands and speaks the Cree language;

(c) Independent and impartial” which shall mean that the Appeal Tribunal member shall:

  • Not be a Citizen;
  • Not be married or live in a common law relationship to a Citizen;
  • Not have a child that is a Citizen;
  • Not have a child that is married or lives in a common law relationship with a Citizen;
  • Not have a parent or grandparent who is a Citizen;
  • Not be employed either as an employee or engaged as a contractor of Thunderchild First Nation or an Empowered Entity or have a material interest in a contract with Thunderchild First Nation or an Empowered Entity or have family members so employed or contracted;
  • Not have had material personal or financial dealings with a party to an Application. 

(d) Has no criminal record” which shall mean that such person has not been convicted of an indictable offense in their lifetime unless such person was pardoned for the offense;

(e) “At no time was disbarred from practicing law” which shall mean disbarment by any Law Society in Canada;

(f) “With preference of appointment given to First Nations persons of Cree ancestry with equal qualification” which shall mean that the person shall possess all of the other qualifications of an Appeal Tribunal member and in the event of relatively equal qualification, Cree ancestry will be the determinative factor, and once an Appeal Tribunal member is appointed the preference issue will be deemed to have been satisfied for the term of such appointment and only revisited on the renewal or the required replacement of such appointment.”

The Litigation Staff Counsel will litigate cases and engage in advocacy to uphold civil liberties and human rights throughout Canada. Responsibilities include developing and litigating impact-driven cases on a wide range of issues at the trial and appellate levels of court, and acting for the BCCLA in test cases, often in partnership with pro bono lawyers.
