The Court of Appeal for Saskatchewan has passed The Court of Appeal Criminal Appeal Rules (Saskatchewan). These new rules apply to criminal practice and procedure before the Court of Appeal. The Court has also passed two new civil Practice Directives (No. 3 and No. 4). These Practice Directives concern the Taxation of Costs and Electronic Filing. All changes were passed as of December 15, 2010, and are effective as of that day.

The Saskatchewan government has introduced amendments to The Election Act that will require voters at provincial elections to produce approved identification.  (The Election Amendment Act, 2010 - Bill 161)

Information Services Corporation (ISC) is adding new measures to enhance the security of all citizens' vital event information. The Vital Statistics Act, 2009, which took effect on December 6th, 2010, contains a number of improvements for the Vital Statistics Registry including new legislation and regulations around who is eligible to request vital event certificates. New Summary Conviction Appeal Rules: The Court of Queen's Bench has approved new Summary Conviction Appeal Rules which it anticipates will become effective on January 1, 2011.

The Institute for Research on Public Policy has announced the winner in the first annual Constitutional Affairs Essay Competition.  Thomas Posyniak from the University of Saskatchewan won the competition with his entry "The National Dimension of Climate Change: A Constitutional Foundation for a National Greenhouse Gas Reduction Policy".

The designation of Queen's Counsel is made by the Minister of Justice through a selection process that includes consultation with the Law Society of Saskatchewan, the Canadian Bar Association and the Courts.

The Law Society is accepting Nominations and the deadline is November 2, 2010. Nomination forms are available.

The Collaborative Lawyers of Saskatchewan Inc. is hosting a Tele-seminar  "Managing Boundaries/Managing Emotions" on Thursday, October 14, 2010.  The seminar will review the impact on emotions on the work that lawyers do.  In family law especially, clients are often overwhelmed and pass that on to their advocates.  This creates a myriad of challenges to lawyers.   This seminar is accredited for 1 CPD hour which qualifies for Ethics Hours.

The Law Society of Saskatchewan accepted the application of Mr. W. Arliss Dellow to resign in the face of discipline proceedings on September 9, 2010.

The Rules of the Court of Queen's Bench for Saskatchewan were amended, effective the 10th day of September, 2010.  Nine new rules were added, three rules were amended, one  tariff of costs schedule was repealed and substituted and one form was amended.

The Practitioner Staff Appeals Tribunal hears appeals from medical practitioners who have been aggrieved by decision of a Regional Health Authority. The Law Society is entitled to recommend 6 candidates to the Minister of Health. The Minister may appoint two of the candidates to a three year term on the Tribunal.

The ideal candidate will have experience in administrative law, appearing both on and before Tribunals. Experience in health law would be an asset.

The Law Society of Saskatchewan has lifted the interim suspension in the discipline matter of  Michelle LeClair-Harding.  Ms. LeClair-Harding is entitled to practice effective June 21, 2010.

CHANGES TO GST IN SASKATCHEWAN - Effective July 1, 2010 - You may think that harmonization of GST/PST in Ontario and BC does not affect us here in good ol' Saskatchewan - WRONG. Effective July 1, 2010, new Rules will come into effect.

On July 1, 2010, tax charged or paid will depend upon the province in which the goods or services are deemed to be provided.

Given the complexity, there will be problems relative to implementation of these Rules, but responsibility remains with the member/firm. In order to assist you, our website provides further information in an article. You may wish to check with your accountant for information and direction on this matter.

The Law Society is exploring the possibility of having a webinar in July on this issue and further information will be provided when available.

Self report your CPD credit hours through your Member Profile on the Law Society website. The Legal Dualism Team of the Department of Justice Canada has prepared a bilingual Legal Dictionary of Property in Canada. There is a free online version that can be accessed by registering at: http://www.dualjuridik.org/UK/Main_Page.awp. This is a work in progress and a "final" hard-copy edition is to be published in 2010-2011.

Wynyard Court House to Re-Open - The major renovations undertaken at the Queen's Bench Court House in Wynyard will be completed and the Court House will re-open effective Monday, May 10, 2010. To facilitate the movement of staff, files and equipment back to the Court House, the temporary office location will be closed during the afternoon of Friday, May 7, 2010. Regular Queen's Bench Chambers sittings will resume at the Wynyard Court House on Tuesday, May 18, 2010 at 1:30 p.m. and on Tuesday, June 15, 2010 at 1:30 p.m.

OTTAWA, April 23, 2010 - The Minister of Justice and Attorney General of Canada announced the appointment of the Honourable Neal W. Caldwell, a partner with the firm McDougall Gauley LLP in Saskatoon, as a judge of the Court of Appeal, to replace Madam Justice D.C. Hunter who elected to become a supernumerary judge effective August 14, 2009.

INCREASE IN COURT FILING FEES ON DIVORCE MATTERS:  Effective April 1, 2010, filing fees on divorce matters in the Court of Queen's Bench increase from $100 to $200 for Petitions and from $30 to $100 for Replies.

Bill 129, The Enforcement of Money Judgments Act is currently before the Legislative Assembly. Professor Ronald C.C.Cuming of the University of Saskatchewan College of Law has prepared a Guide to this major new law reform Bill. In the Guide, Professor Cuming provides both a description and an analysis of the new structure for money judgment enforcement in Saskatchewan contained in Bill 129, The Enforcement of Money Judgments Act. The Guide addresses the conceptual underpinnings of the new system and a detailed examination of its provisions. This Guide is available as a free down-load from the website of the Queen's Printer.

The Law Society of Saskatchewan is committed to providing continuing professional development opportunities to the profession. The CPD Planning Committee will assist the Director of Education in the selection of subject matter and the organization and delivery of continuing professional development programming.

The Law Society is seeking applications for the CPD Planning Committee. Selection for the Committee should be representative of the profession including diversity in practice, geographic location, gender etc. An interest or experience in education would also be an asset.
