12.9 – Will the Client’s Matter Require More Resources and Time Than You Can Provide?

As a part of the duty of competence reviewed above, the Code of Professional Conduct requires a lawyer to determine whether they know the law and procedure for the matter in question. A lawyer must also exercise their discretion to ensure that besides having the requisite knowledge, they have the adequate time and resources to provide timely service to the potential client.

To properly consider this question when screening a potential client, you must be aware of the client’s expectations as well as any important dates and limitations related to their file. If you are too busy to give the client the adequate time and attention their file will need, you should not enter into a relationship with that client.
