DESCRIPTION:Qualifies for 1.5 CPD hours\, all of which qualify for Ethics. \nThis is a replay of the Oct 26th presentation for Access to Justice Week: This talk presents the results of an Access-to-Justice legal needs assessment of Two Spirit\, trans\, non-binary and gender nonconforming (2STNBGN) people conducted by JusticeTrans across the lands colonially known as Canada. This presentation will focus on how discrimination and harassment cuts across other legal issues\, including those related to employment\, housing\, migration\, and medical treatment. Through a series of participant quotes\, we will break down how transphobia\, transmisogyny\, racism\, and colonization are experienced at both a structural and personal level resulting in a distrust and disengagement of the legal system. To close\, we will examine participants’ visions of a more just future\, which evoke both immediate reform and education work\, as well as long-term structural changes including the abolition of police and prisons\, and the decolonization of the legal system. \nPresenters: Cat Haines\, Executive Director\, Justice Trans. SUMMARY:Webinar - Making Parenting Plans: Helping Lawyers to Facilitate Resolution of Parenting Disputes (CPD 343)
DESCRIPTION:Qualifies for 1.0 CPD hour. \nThe Divorce Act amendments (Bill C-78) and Saskatchewan Children’s Law Act 2020\, reforms that came into effect in March 2021\, include provisions to encourage parents to make parenting plans (or agreements) that govern parenting time\, parental decision-making and other issues related to children. These plans may include aspirational statements about the parents’ expectations for themselves and their children. These plans\, or parts of them\, may be incorporated into court orders. Parenting plans are generally expected to evolve as children grow older and the circumstances of the children and their parents change\, giving rise to questions about how much detail to include in a parenting plan\, or the portion included in a court order. \nThis program will survey the child development literature\, legal principles\, and practical considerations that lawyers need to consider in making parenting plans\, including issues related to scheduling and parental decision-making\, as well as offering advice about negotiating plans in higher conflict cases. It will include reference to the Parenting Plan Guide and Template prepared by the Ontario Chapter of the Association of Family & Conciliation Courts (AFCC-O) and materials prepared the Department of Justice that can assist lawyers\, judges and parents in making parent plans\, as well providing templates for terms that may be included. \nPresenters: Nicholas Bala and Rachel Birnbaum

SUMMARY:Free Workshop - Code of Conduct Amendments: Direct Supervision Requirements (CPD 347)
DESCRIPTION:Qualifies for 2.0 CPD hours\, all of which qualify for Ethics \nThe Law Society of Saskatchewan is implementing recommendations from the final report of the Legal Services Task Team. Recommendation No. 4 identified direct supervision requirements as an area to examine more closely in order to increase access to legal services. The Code of Conduct provides guidance to lawyers providing direct supervision. Since December of 2021\, the Law Society has been engaged in outreach and consultation on proposed amendments to direct supervision requirements in the Code of Conduct. This involved many stakeholders\, including focus group discussions with 133 participants and an online survey completed by 324 individuals – 189 lawyers and 135 paraprofessionals. \nAs a result of these consultations\, the Code of Conduct has been amended to allow greater flexibility for staff working under the supervision of a lawyer to provide delegated legal services. Importantly\, lawyers maintain responsibility for all delegation at their discretion – it is not mandatory but rather possible to expand delegation in appropriate instances where the knowledge\, skills\, and experience of staff so permit. \nObjectives \nJoin this workshop to learn: \n\n-the new regulatory framework and practice for direct supervision;\n-how direct supervision provides the opportunity to increase access to legal services;\n-the business case for effective use of direct supervision;\n-lessons from insurance claims regarding direct supervision\, managing client expectations and interacting with clients and other legal professionals via direct supervision; and\n-good practices and dealing with challenges that can arise in direct supervision.\n\nPresenters will include the Law Society’s Director of Regulation\, Saskatchewan Lawyers’ Insurance Association\, and practitioners.
