Suing me or Sent to Collections
It is not professional misconduct for a lawyer or limited licensee to collect on overdue payments. To collect an overdue payment, a lawyer or limited licensee can:
- charge interest;
- take the matter to small claims; or
- send the overdue account to a collection agency.
Note that a lawyer or limited licensee may also divulge confidential information, but only to the extent necessary, to collect a fee.
See section 3.3-3B(b) of the Law Society of Saskatchewan Code of Professional Conduct for Lawyers or the Law Society of Saskatchewan Code of Professional Conduct for Limited Licensees for more information.
