Personal Information Lost or Stolen
It can be scary if your paper file or digital personal information is illegally accessed. If your confidential information is compromised, your lawyer or limited licensee should:
- notify you
- explain the risk of your information being disclosed – for example, there may be lower risk if your file is password protected
- contact the police if an illegal activity has occurred
- advise the Law Society of the breach
Your lawyer or limited licensee also has insurance that may cover any financial damages to you that happen because of the disclosure of your confidential information.
If you believe your lawyer or limited licensee has not managed a confidentiality breach appropriately, submit a complaint.
Common Questions
Legal proceedings are needed to get compensation from your lawyer or limited licensee for an error, omission or negligent conduct. This involves a legal process to prove their negligence and how it affected you financially to receive an award of damages.
The Law Society cannot:
- pursue legal action against lawyers or limited licensees for negligence on your behalf
- provide compensation to complainants
You may wish to get legal advice, as lawyers and limited licensees in Saskatchewan must maintain insurance coverage for errors, omissions or negligent conduct. Such insurance is required to provide protection to the public.
You may wish to contact the lawyer or limited licensee to see if they would be willing to cover the cost of your credit monitoring for a year. Note that the lawyer or limited licensee is not obligated to do so.
