Previous Matter Related to Current Matter
A lawyer or limited licensee must not work against a client in the same case or a related case unless the client agrees. The new work of the lawyer or limited licensee must be unrelated to the work they did for the client. The following provides an example of related matters:
- A lawyer represented a company called Cluckychicken Co. in defence of several complaints to the Workers’ Compensation Board.
- The lawyer is then hired to represent another company, United Frying Pan Inc., in its hostile takeover bid for Warm Wooly Mittens Ltd.
- Warm Wooly Mittens Ltd. is a subsidiary company of Cluckychicken Co.
See section 3.4-10 of the Law Society of Saskatchewan Code of Professional Conduct for Lawyers or the Law Society of Saskatchewan Code of Professional Conduct for Limited Licensees for more information.
A lawyer or limited licensee may continue to represent a client, if the client provides consent. See section 3.4-2 of the Law Society of Saskatchewan Code of Professional Conduct for Lawyers or the Law Society of Saskatchewan Code of Professional Conduct for Limited Licensees for more information.
If you believe a lawyer or limited licensee has acted against the interests of a client by acting in a related matter, submit a complaint.
