If you believe you will be materially prejudiced, you should:
- communicate that to the lawyer or limited licensee; and
- work with the lawyer or limited licensee to have the invoice paid.
- This can be either through an arrangement to secure the fees or a payment plan.
- The lawyer or limited licensee may ask your new lawyer or limited licensee to agree to conditions on delivery of the file.
- The lawyer’s conditions should be reasonable.
