Not Explaining
Legal processes can be complicated. A client should never feel foolish for asking for clarification from their lawyer or limited licensee. Your lawyer or limited licensee should be able to answer your questions, such as:
- what certain legal terms mean
- what action is needed
- what the steps are in a process
Answering a client’s questions is different than telling the client what they want to hear. Lawyers and limited licensees are required to give an honest explanation or opinion. This includes:
- giving the client all information known to the lawyer or limited licensee that may affect the client’s interests
- telling the client what they honestly think about the merits of the case and probable results
See section 3.2-2, commentaries [2] and [3] of the Law Society of Saskatchewan Code of Professional Conduct for Lawyers or the Law Society of Saskatchewan Code of Professional Conduct for Limited Licensees for more information.
If you need more of an explanation from your lawyer or limited licensee, reach out to them and put your questions in writing. Click “Discuss with Lawyer or Limited Licensee” below to see more about this option, what to do next, and a sample letter you can use.
