Poor Quality of Work
Poor quality of legal work could mean that the lawyer or limited licensee was either:
- Negligent – this means the lawyer or limited licensee is generally skilled and knowledgeable but made a mistake. Examples of negligence may include:
- missing a deadline or limitation period;
- misreading (or not reading) a survey, search or reference plan in a real estate deal; or
- a case is dismissed because the wrong party was named.
- Incompetent – this means the lawyer or limited licensee did not have the appropriate knowledge, skills or attributes to handle the matter. Examples of incompetence include not providing adequate advice or service due to:
- not having sufficient training or experience in the particular area of law; or
- being impaired by a health issue (for example, addiction, mental health issue or cognitive issue).
