Beneficiary or Should Be Beneficiary
The roles of the executor or administrator, and the estate lawyer or limited licensee, are different. Each has different duties and responsibilities. The executor is a person named in a Will to carry out the terms of the Will. The administrator is a person appointed by the court to manage an estate where there is no Will, or where the executor named in a Will cannot or will not manage the estate. The estate lawyer or limited licensee provides advice and legal assistance to the executor or administrator and owes their main duty to the estate. It is possible for a lawyer or limited licensee to act as an executor or administrator.
Is your concern with a lawyer or limited licensee who is representing the estate, or with a lawyer or limited licensee who is acting as the executor or administrator of an estate?
