Compensation for Financial Loss
It is important to know the difference between a lawyer or limited licensee:
- making a mistake (negligence), and
- giving poor-quality legal help (incompetence).
Negligence means the lawyer or limited licensee made a mistake, but still has the skills and knowledge to handle cases like yours.
Incompetence means the lawyer or limited licensee did not have the right knowledge, skills, or abilities to deal with your matter. See section 3.1-1 of the Law Society of Saskatchewan Code of Professional Conduct for Lawyers or the Law Society of Saskatchewan Code of Professional Conduct for Limited Licensees for more information.
Examples of negligence include:
- Missing a deadline or limitation period
- Misreading (or not reading) a survey, search, or reference plan in a real estate deal
- Having a case dismissed because the wrong party was named
Not winning your case usually does not mean your lawyer was negligent.
