Negligence
Lawyers and limited licensees in Saskatchewan must maintain insurance coverage for errors, omissions or negligent conduct. Insurance is required to provide protection to the public. If a lawyer or limited licensee made a mistake:
- they are obligated to notify you and their insurer; and
- it must be reported as soon as practicable after learning of the claim or becoming aware of circumstances which might give rise to a claim.
See sections 7.8-1 and 7.8-2 of the Law Society of Saskatchewan Code of Professional Conduct for Lawyers or the Law Society of Saskatchewan Code of Professional Conduct for Limited Licensees for more information.
Legal proceedings are needed to get compensation for an error, omission or negligent conduct. This involves a legal process to prove the negligence and how it affected you financially to receive an award of damages.
The Law Society cannot:
- pursue legal action against lawyers or limited licensees for negligence on your behalf; or
- provide compensation.
You may wish to get legal advice to assist with this process.
