Remove Lawyer or Limited Licensee From Matter
A client can end the relationship with the lawyer or limited licensee at any time, unless the lawyer is appointed by the court. In certain circumstances a lawyer may be required to obtain leave from the court to withdraw even if the client wants to end the relationship. Note that a limited licensee cannot be appointed by the court.
The Law Society has no authority to remove a lawyer or limited licensee from a matter. A court application is required, and you may wish to seek legal advice.
If you believe the lawyer or limited licensee has breached their duty to avoid a conflict of interest, please see:
- for your own lawyer or limited licensee, the client Conflict of Interest pathway.
- for opposing counsel, the opposing party Conflict or Want Removed page.
