Business or Financial Transactions With Client
A lawyer or limited licensee may be in a conflict of interest if they are involved in a financial transaction or conduct business with a client that:
- conflicts with a client’s interests
- impacts that lawyer or limited licensee’s ability to provide unbiased counsel
Having a business dispute with someone who happens to be a lawyer or limited licensee is likely not a conduct issue. For example, buying a house from a seller who also happens to be a lawyer or limited licensee, and discovering a basement problem after the purchase.
