Made Misrepresentations
A lawyer must not knowingly assist in or encourage any dishonesty. This includes making misrepresentations in court. Making misrepresentations in court can include:
- offering false evidence;
- misstating facts or law;
- presenting or relying on a false or deceptive affidavit;
- suppressing what should be disclosed; or
- knowingly misstating the contents of a document or the testimony of a witness.
See section 3.2-7 of the Law Society of Saskatchewan Code of Professional Conduct for Lawyers for more information.
Has there been a finding by the court that the Crown prosecutor made misrepresentations?
