No Finding by the Court
The court’s role is to:
- review the arguments and materials of both parties; and
- determine whether or not information or documentation is relevant and should be disclosed.
The court then renders the decision based on that evidence.
The Law Society does not have the jurisdiction to:
- review the court record;
- perform the same assessment as the court; or
- make a finding that the information or documentation is relevant and should be disclosed.
If you obtain a fiat, order or judgment from the court that addresses the conduct of the Crown prosecutor regarding improper disclosure, provide a copy of that fiat, order or judgment and submit a complaint.
