Breach of Confidentiality
A lawyer or limited licensee owes a duty of confidentiality to their client. Generally, the opposing counsel owes you no duty of confidentiality unless there is a:
- court order which includes:
- the sealing of documents; or
- a media ban;
- non-disclosure agreement; or
- trust condition or undertaking about use of information.
If the opposing lawyer or limited licensee breached the duty of confidentiality they owe to you, submit a complaint.
