Inappropriate Legal Tactics
A lawyer or limited licensee must do their best to help their client, while following the applicable rules of court.
Opposing counsel (the lawyer or limited licensee for the other side):
- owes you no duty; and
- may do things you do not like or agree with.
You might disagree with what the opposing lawyer or limited licensee is doing, but if they are just doing their job to help their client, that is usually not misconduct. Lawyers and limited licensees speak for their clients, and the court decides who is right.
The Law Society cannot say if a legal action is right or wrong. Only the court can decide that.
If you do not agree with what the opposing lawyer or limited licensee is doing, you might be able to take legal steps – you may wish to seek legal advice.
The Law Society may not review the matter unless the court says the lawyer or limited licensee did something wrong.
You should submit a complaint if:
- the court sanctions the lawyer or limited licensee;
- the court comments on the lawyer or limited licensee’s conduct in the matter; or
- if you believe the tactics a lawyer or limited licensee is using are unethical.
