No Finding by the Court
The court’s role is to:
- review the submissions and materials of both parties; and
- assess the credibility of the evidence before them.
The court then renders a decision based on that evidence.
The Law Society does not have the jurisdiction to:
- review the court record;
- perform the same credibility assessment as the court;
- make a finding that the statements were false; or
- make a finding that the lawyer or limited licensee counselled their client to make false statements.
If you obtain a fiat, order or judgment from the court that addresses the conduct of the lawyer or limited licensee in relation to a misrepresentation, provide a copy of the fiat, order or judgment and submit a complaint.
