CPD 405 – Getting It Done: Resolving Family Proceedings on a Final Basis without Going to Trial

Join us for a full-day recorded seminar on resolving Family Law matters at various stages of proceedings prior to trial. From summary judgment applications to binding pre-trial conferences, the morning sessions will inform practitioners of their duties when preparing for applications, negotiations, and settlement of claims. Presenters will provide guidance for running an effective pre-trial conference with topics such as preparing the pre-trial brief, applications in advance, and considerations around self-represented litigants and interpersonal violence. The afternoon will focus on effective documentation of resolutions using Interspousal Agreements and Minutes of Settlement. The sessions will provide drafting considerations involving tax implications and dealing with third parties and will discuss when to consider pursuing a final Judgment. Presenters will explore avenues for further resolution when the pre-trial conference does not result in a settlement, or there is a desire to vary the terms of the settlement. This will include discussion of the legislation, case law and process around viva voce hearings.
