Looking For Lost Wills

Have you or a family member lost track of your lawyer and need to locate a will or estate file? If so, we may be able to help. The Law Society of Saskatchewan maintains a Lost Wills List. Please submit the Lost Wills Form by filling in the information below and clicking on ‘Submit’ at the bottom of the page. Please provide as much detail as possible about the person who made the will (the testator or the deceased) in the form below.  

The information provided will be circulated among Saskatchewan’s lawyers for review. Placement on the Lost Wills List does not guarantee that a lawyer will locate the missing will. Lawyers who review the List and recognize a client name may follow-up with you directly.   

Due to the personal information included on the List and to safeguard privacy, the List is only accessible to Saskatchewan lawyers using login credentials and to the individuals who work at the Law Society. 

You are also encouraged to consider other options for finding a lost will. Try contacting the Saskatchewan Courts Wills and Estates Registry to see if they have a copy on file:

Frequently Asked Questions

How can the Law Society help me if a will has been lost?

If you or a family member has lost track of your lawyer and need to locate a will or estate file, the Law Society may be able to assist by connecting you with the lawyer or law firm that has the information you are looking for. The Law Society maintains a Lost Wills List that is shared with Saskatchewan lawyers. The List posts the information submitted in the Lost Wills Form (below), containing your contact information as well as the information of the deceased / testator (person who made the will) to ensure the lawyer or law firm can properly confirm if they have the information you are looking for.  Lawyers who review the List and recognize a client name may follow-up with you directly. 

How long will it take to find the lost will?

There is no guarantee that a lawyer or law firm will locate the missing will, however, lawyers are reminded to review the Lost Wills List regularly to increase the possibility that a lawyer or law firm will recognize a client’s name and locate the will you are searching for. 

How long will a posting remain active?

The information from your Lost Wills Form will be posted to the Lost Wills List within three business days. Postings remain active for five years. In the event you locate the will you are searching for, please contact the Law Society to remove the posting from the List. If you would like to renew the posting after five years, you will need to complete a new Lost Wills Form. 

How will personal information be protected?

Due to the personal information included in the Lost Wills List and to safeguard privacy, the List is only accessible to Saskatchewan lawyers using login credentials and to individuals who work at the Law Society. 

What else can I do to find a lost will?

You are encouraged to also consider other options for finding a lost will. Try contacting the Saskatchewan Courts Wills and Estates Registry to see if they have a copy on file:

From a search of the Wills and Estates Registry, you can determine whether a court file exists, the nature of the application, the name of the applicant, and the court house where the actual file is located. You can then contact the appropriate court house to obtain copies of any documents on the court file. 

If a court file does exist, it will generally contain the following information: 

  • the original will, if one exists; 
  • a list of beneficiaries or other persons who may have an interest in the estate; and 
  • a list of all the assets of the deceased. 

It is important to note that not all estates require probate. This registry is a listing of the estates that had to go through court only, not every estate in Saskatchewan.
