The Intestate Succession Act, 2019

In May 2019, The Intestate Succession Act, 2019 was
passed by the Legislative Assembly of Saskatchewan. On October 1,
2019,The Intestate Succession Act, 2019 will come into force.
The new Act will repeal and replace the existing Act and
includes provisions that:
Clarify when a spousal relationship has terminated for the
purposes of the Act;
Provide that the spousal preferential share will be set out in
the Regulations;
Provide that the spouse inherit the entire estate if all
children of the intestate are shared between the spouses;
Adopt a parentelic model for distribution;
Eliminate the doctrine of advancement; and
Generally update the language in the Act.
The Regulations accompanying the Act set the amount of the
preferential share.
