Research Tip: Annotated Criminal Codes … Online!
December 13, 2019When you need to know the history of a certain legislative provision, you can’t really beat an online annotated code – judicial citations, legislative histories, indexing, searchability, downloading – full functionality in a single source. So I am pleased to say that if you are a Saskatchewan lawyer, or otherwise subscribed to CriminalSource in WestlawNext Canada, then you have access to not one but THREE online annotated Criminal Codes:
- Martin’s Annual Criminal Code – when lawyers ask me for a copy of the Criminal Code, they most often mean Martin’s, published by Canada Law Book since 1955.
- Tremeear’s Annual Criminal Code (Tremeear’s Annotations in WLN) – Tremeear’s or Martin’s? Which is best? No one knows. First published in 1919 by Burroughs company in Calgary, Tremeear’s vies with Martin’s for popularity among criminal practitioners and judges.
- Crankshaw’s Criminal Code of Canada – while Tremeear’s and Martin’s remained concise and portable, Crankshaw’s went big, expanding to multiple volumes with extensive legislative histories and case histories for every section. The oldest of the three, Crankshaws was first published in 1894 by Whiteford & Theoret in Montreal.
Saskatchewan practitioners can access these annotated codes through the Member Resource Section of the Law Society website. Scroll down to WestlawNext Canada and find “CriminalSource.” Once you are there, all three can be found in the list of “Texts and Annotations.”
