The Bill C-78 Divorce Act Changes: What you need to know

February 3, 2021

Substantial changes to the Divorce Act come into force on March 1, 2021. Experts from the Family and Children’s Law Team, Department of Justice Canada, are offering free virtual training to provide you with an overview of the amendments.

This course will be helpful to those who need an introduction to the amendments and to those who need a refresher on the eve of implementation.

It is likely to be of interest to lawyers, courts and dispute resolution practitioners, as well as other family justice professionals.

The course will cover the following:

  • Status of Act, objectives
  • Language of parenting, parenting orders
  • Best interests, family violence
  • Relocation: process, substantive law
  • New duties: courts, parents, lawyers
  • Jurisdiction for parenting orders
  • Official Languages amendments
  • Inter-jurisdictional support
  • FOAEA Act  changes
  • Regulations, consequential changes, etc.

Accreditation by Law Societies:

Barreau du Quebec: This activity may be eligible for up to 3 hours of continuing education content (but ultimately it is the lawyer’s responsibility to determine whether it fits the BQ’s regulation concerning mandatory continuing education activities)

Law Society of British Columbia: The Department of Justice Canada (Legal Practices Policy Division – LPPD) is a pre-approved provider; this activity counts for up to 3 hours

Law Society of New Brunswick: application in process

Law Society of Ontario: This activity is eligible for up to 3 hours of Substantive content (but ultimately it is the lawyer’s responsibility to determine whether the activity qualifies under the LSO’s CPD Requirement regarding the Substantive content)

Law Society of Saskatchewan: This activity is accredited for 3 CPD hours

Modifications apportées à la Loi sur le divorce par le projet de loi C-78 : ce que vous devez savoir

Des modifications importantes à la Loi sur le divorce entreront en vigueur le 1er mars 2021. Des experts de l’Équipe du droit de la famille et des enfants du ministère de la Justice Canada offrent une formation virtuelle gratuite pour vous donner un aperçu des modifications.

Ce cours sera utile à ceux qui ont besoin d’une introduction aux modifications et à ceux qui ont besoin d’une mise à jour à la veille de la mise en œuvre.

Le cours est susceptible d’intéresser les avocats, les tribunaux et les praticiens du règlement des différends ainsi que d’autres professionnels de la justice familiale.

Le cours traitera des éléments suivants :

  • Statut de la Loi, objectifs
  • Terminologie relative au rôle parental, ordonnances parentales
  • Intérêt de l’enfant, violence familiale
  • Déménagement important : processus, droit substantif
  • Nouvelles obligations : tribunaux, parents, avocats
  • Compétence relative aux ordonnances parentales
  • Modifications relatives aux langues officielles
  • Demandes interprovinciales ou internationales en matière d’aliments
  • Modifications à la LAEOEF
  • Règlements, modifications corrélatives, etc.

Barreau de la Colombie-Britannique : Le ministère de la Justice du Canada (Division de la politique des pratiques juridiques- DPPJ) est un fournisseur préapprouvé : cette activité compte pour un maximum de 3 heures de formation.

Barreau du Nouveau-Brunswick : la demande est en cours de traitement.

Barreau de l’Ontario : Cette activité est admissible pour un maximum de 3 heures de contenu substantif (mais il est de la responsabilité de l’avocat de déterminer si l’activité de formation correspond à l’exigence de formation continue du Barreau de l’Ontario concernant le contenu substantif).

Barreau du Québec : Cette activité peut possiblement être admissible pour un maximum de 3 heures de formation continue (mais il est de la responsabilité de l’avocat de déterminer si l’activité de formation correspond au Règlement sur la formation continue obligatoire des avocats du Barreau du Québec).

Barreau de la Saskatchewan : Cette activité est accréditée pour une durée de 3 heures de FPS

        How does one register for the courses on Family Law available February 22-25,2021? I am not a lawyer. I am needing these courses to go towards becoming a parenting coordinator contracted to work with families regarding custody and access through the Early Family Resolution program. What is the cost?
