Discipline Decision
September 29, 2020A decision has been released concerning the matter of Law Society of Saskatchewan v. Evatt Anthony Merchant, Q.C. The following allegations against the Member were proven:
- did in relation to a client of his firm, J.S., induce J.S. to provide a form of assignment in relation to an amount payable pursuant to The Indian Residential Schools Agreement when such conduct was prohibited; and
- did in relation to a client of his firm, J.S., cause a form of assignment in relation to an amount payable pursuant to The Indian Residential Schools Agreement to be acted upon when such conduct was prohibited.
The following penalty was imposed by the Hearing Committee:
a. IT IS ORDERED THAT Evatt Anthony Merchant, Q.C. is suspended for a period of eight (8) months effective February 1, 2021;
b. IT IS FURTHER ORDERED THAT Evatt Anthony Merchant, Q.C. shall pay costs to the Law Society of Saskatchewan in the amount of $10,643.00 forthwith, or such other date as the Chair of Discipline may approve.
